WHY THIS IS IMPORTANT

The rules are becoming stricter. Even so, silence is not a strategy.

Companies measure emissions, change processes, set targets, and support projects. This work must remain visible.

With EmpCo, the requirements for climate and environmental claims are increasing. The better response to this is not to say nothing at all anymore. It is to show exactly what has been done, what a claim is based on, and where its limits lie.

"Gives you wings" is understood by everyone as advertising. "Climate-friendly" sounds like a finding. And findings require evidence.

Green words need solid ground.

It is not only crucial whether a sentence is correct in itself. The context, data basis, and overall impression must also fit together.

The EmpCo Directive was implemented into German law via the UWG (Act Against Unfair Competition). The new requirements are to be applied from 27 September 2026. This page provides general guidance and does not replace a legal assessment of individual cases.

The short answer is usually: it depends on the specific statement and its overall impression. Here is a more detailed look.

Does EmpCo also affect B2B companies?

The new EmpCo requirements apply to commercial communications directed at consumers. This becomes particularly relevant for B2B companies when statements appear publicly on websites, products, packaging or in other consumer-facing media. Purely internal corporate communications or communications exclusively relating to B2B are to be considered separately.

Are terms such as 'sustainable' or 'environmentally friendly' completely banned?

Not every environmental term is automatically banned. However, general environmental claims will be significantly more restricted. What matters is the specific wording, the evidence available, and the overall impression created by the presentation.

Does every piece of climate or CO₂ information have to be certified?

There is no general certification requirement for factual, specific CO₂ information. Private sustainability labels are subject to their own requirements. Even without a label, information must be true, clearly defined, verifiably documented, and not misleading in its overall impression.

Is the natureOffice check a legal consultation?

We examine the technical basis, the communicative context and typical risks. Where an individual legal assessment makes sense, we identify the need for examination. We do not make a blanket promise of legal approval.

Can you revise an existing sustainability report?

Yes. We can review the structure, statements, data references and comprehensibility, add missing classifications, and edit the report. On request, we can also support the creation from scratch.
